الملخص
Islamic finance engineering seeks to develop innovative financing structures that meet the needs of institutions for financing sources tailored to their specificities, characterized by sufficient flexibility to provide new opportunities for financing seekers and to effectively manage financial risks to address the fluctuations in costs, revenues, and consequently, their profitability. Simultaneously, these structures adhere to the principles and foundations of Islamic finance and banking. In this context, Islamic swaps contracts have emerged as a financial engineering tool aimed at better managing financial risks and hedging. However, their emergence has been accompanied by controversy over their legitimacy. This research paper aims to conduct an analytical study highlighting various opinions on the legitimacy of Islamic swaps contracts and proposed alternatives, along with a review of their practical application in some leading countries in the field of Islamic finance banking. Keywords: Islamic Finance Engineering, Islamic Swaps, Risk Management, Hedging Jel Classification Codes : G32 ; G21 ; G41 ; D81. ملخص تسعى الهندسة المالية الإسلامية لإيجاد صيغ تمويل مبتكرة تستجيب لاحتياجات المؤسسات لمصادر تمويلية تتلاءم مع خصوصيتها وتتميز بالمرونة الكافية لاتاحة مزيد من الفرص الجديدة للباحثين عن التمويل وتمكنها كذلك من إدارة المخاطر المالية لحل مشكل التذبذبات التي تشهدها تكاليفها وعوائدها وبالتبعية مردوديتها، وفي نفس الوقت تتماشى مع أسس ومبادئ التمويل والصيرفة الإسلامية. في هذا السياق، ظهرت عقود المبادلات الإسلامية كأحد أدوات الهندسة المالية الهادفة لتحكم أفضل في المخاطر المالية والتحوط. إلا أن ظهورها صاحبه خلاف حول مشروعيتها. تهدف هذه الورقة البحثية للقيام بدراسة تحليلية تبرز مختلف الآراء حول مشروعية عقود المبادلات الإسلامية والبدائل المقترحة مع استعراض واقع الممارسات التطبيقية لها في بعض البلدان الرائدة في مجال الصيرفة المالية الإسلامية. الكلمات المفتاحية: الهندسة المالية الإسلامية، عقود المبادلات الإسلامية، إدارة المخاطر، التحوط تصنيف JEL: G32 ; G21 ; G41 ; D81.
