الملخص
حضيت أحكام الأسرة في الإسلام بعناية ربانية، جاءت في تشريع محكم تحقيقا لمقاصد حفظ النفس والنسل والعرض، وتكوين أسرة أساسها المودة والرحمة، ولما كان الطلاق يهدد الإسقرار الأسري والنسيج المجتمعي كانت أحكامه ذات أهمية بالغة، و كما هو معلوم فإن الطلاق يكون باللفظ أو بالكتابة أو بالإشارة، ولما غلب على الناس إيقاعه باللفظ كان لابد من توضيح هذه المسألة التي تعم بها البلوى، من خلال ضبط ألفاظ الطلاق عند المالكية والقانون الجزائري وبيان أثرها، وتنبيه المقنن الجزائري على المواطن التي خالف فيها الشريعة الاسلامية، وفي هذا تقديم مساعدة فقهية للقاضي، خاصة مع غياب العناية بموضوع ألفاظ الطلاق رغم أثره المباشر على الحياة الزوجية. The provisions of the family in Islam have been observed with divine care, which came in tight legislation to achieve the purposes of preserving oneself, offspring, and honour, and forming a family based on affection and mercy, and since divorce threatens family stability and the societal fabric, its provisions were of great importance, and as it is known, divorce is verbal, written, or By reference, and when people were overwhelmed by its verbal rhythm, it was necessary to clarify this issue in which the affliction pervades, by controlling the words of divorce in Maliki and Algerian law and explaining their impact, and alerting the Algerian codified on the places in which it violated Islamic law, and in this providing jurisprudence assistance to the judge, especially With the absence of attention to the subject of divorce words despite its direct impact on marital life.
