الحماية القانونية للتراث الثقافي في الجزائر

الملخص
تعالج هذه الورقة البحثية موضوع الحماية القانونية للتراث الثقافي من منظور التشريع الجزائري، حيث أن التراث الثقافي بأنواعه المختلفة هو رابطة قوية بين حاضر الشعوب وماضيها، فمن خلاله يمكن تناقل مختلف القيم الروحية والمادية بين الأجيال المتعاقبة لنفس الأمة أو لنفس الدولة، كما أنه يمثل ثروة ذات قيمة مادية ومعنوية يجب حمايتها لتحقيق الإستفادة المرجوة منها. ولأن التراث الثقافي يتعرض في الكثير من الأحيان وفي العديد من البلدان لأعمال التخريب والسطو والتهريب والمتاجرة غير المشروعة، كما قد يكون محلا للنزاعات من أجل الاستيلاء عليه بشكل رسمي أو غير رسمي، فضلا عن انتشار أفكار العولمة التي تتبنى الحداثة في المجتمعات في مقابل طمس الهوية الثقافية للأمم والشعوب، كل ذلك دفع بالمجموعة الدولية إلى العمل على توفير الحماية الكافية للتراث الثقافي ومن ذلك الحماية القانونية، وفي هذا الصدد اتخذ المشرع الجزائري سياسة حمائية من خلال سنه للقانون رقم 97-10 المتعلق بحقوق المؤلف والحقوق المجاورة، والقانون رقم 98-04 المتعلق بحماية التراث الثقافي. Abstract: This research paper deals with the legal protection of cultural heritage from the perspective of Algerian legislation, whereas cultural heritage of various kinds is a strong link between the present and the past of peoples, through it; various spiritual and material values can be transmitted between successive generations of the same nation or people, and it represents wealth of material and moral value that must be protected to achieve the desired benefit. Because cultural heritage is often exposed in many countries to acts of vandalism, robbery, smuggling and illicit trafficking, and may be subject to disputes for formal or informal appropriation, as well as the spread of ideas of globalization that adopt modernity in societies in exchange for obliterating the cultural identity of nations and peoples, all this prompted the international community to work to provide adequate protection for cultural heritage, including legal protection. In this regard, the Algerian legislator adopted a protectionist policy by enacting Law N° 97-10 on copyright and related rights, and Law N° 98-04 on the protection of cultural heritage.
