الملخص

يهدف هذا البحث إلى إبراز بعض الجوانب الواقعية لمسالة الإعاقة و كيف رعتها الشريعة الإسلامية. انطلاقا من كون الإعاقة مرتبطة بالإنسان من حيث وجوده وليست مقتصرة على زمن معين أو مجتمع بذاته بل أن التعامل معها هو العنصر المتغير من حضارة إلى أخرى ومن زمن إلى أخر ، وقد تطرقت الشرائع السماوية لمسألة الإعاقة وأحاطت بجوانبها و سبل التعامل مع أصحابها ، وكانت الشريعة الإسلامية بمختلف مصادرها ( القرآن الكريم و السنة النبوية الشريفة) وباعتبارها خاتمة لرسالات و منهاج حياة صالح لكل زمان ومكان، فقد رعت مسألة الإعاقة حق رعايتها وكفالتها بما يجيب من حيث حقوق المعاق في مجتمعه و كذا واجباته تماشيا مع مبدأ التكليف و إحقاقا للحق و مراعاة الخصوصية بما يكفل التوازن فلا إفراط و لا تفريط، وهي حقائق موضوعية بعيدة عن الذاتية وهو ما توثقه النماذج الرائدة في تاريخنا الإسلامي في العناية و التعامل مع فئة ذوي الاحتياجات الخاصة. This research aims to present some realistic aspects of the issue of disability in Islamic religion. Based on the fact that disability is related to a person in terms of his existence and is not limited to a specific time or society in itself, but rather that dealing with it is the variable element from one civilization to another. With its various sources (the Noble Qur’an and the noble Prophet’s Sunnah) and as it is the conclusion of messages and a way of life that is valid for every time and area, the issue of disability has taken care of the right to fear it and guaranteed it with what is answered in terms of the rights of the handicapped in his community as well as his duties in line with the principle of assignment and the right to the right and the observance of privacy in terms of Ensures balance, neither excess nor, and We also try to include pioneering models in our Islamic history
