الملخص

ملخص جاء البحث لبيان مناهج الأصوليين في العدول عن الظاهر إما لتعذر الحمل على المعنى المتبادر، أو لمرجوحيته؛ فقد عالجنا كيفية توضيح ذلك العدول، وكيف تجاوز المجتهدون باللفظ؛ ليصلوا إلى معنى أوسع. وللعدول صور عديدة كتخصيص العام، وتقييد المطلق وغيرهما، وقد أوضحنا مناهج الأصوليين في العدول باللفظ، وأظهرنا المقارنات في المذهب الواحد؛ للوصول إلى رؤية واضحة، مبينين ضوابط العدول عن ظاهر اللفظ؛ لفهم كلام المشرع على الجهة المقصودة؛ ولتحقيق المصالح، ودرء المفاسد، وتمثلت مشكلة البحث الرئيسية في الفهم الخاطئ لمناهج الأصوليين في العدول عن ظاهر اللفظ، والقصور في معرفة الفلسفة التشريعية في مجيء النصوص على جهة الاحتمال، واتبعنا المنهج الاستقرائي الجزئي والمنهج التحليلي للوصول إلى نتائج الدراسة وأهمها: عدم العدول لمصلحةٍ معارِضَةٍ للظاهر، وألا يعود العدول على النص بالإبطال وإنما توسيع لأفق النص، ومحل الحكم، ووسيلة العدول عن ظاهر النص الاجتهاد، ويشترط للعدولِ عن الظاهر أن يكون محتمِلًا للمعنى المُراد صرْفُهُ إليه. Abstract This study aimed at highlighting the jurists' approach in going beyond theexplicit meaning. This is due to non-reliance onexplicitmeaningor non-clarity in the meaning conveyed. Specifically, the study tries to point out this abandoning and how scholars have gone beyond the phenomenon of explicitness to reach a more comprehensive meaning,Thisanalysis approach has several forms including particularizing and restricting meaning, to name a few. The main research problem was the misunderstanding of the jurists' approaches to abandoning the apparent expression, And we followed the partial inductive approach and the analytical approach to reach the results of the study, the most important of which is: not to refer to equipment opposing the apparent, and not to return to the text by invalidation, but rather to expand the horizon of the text, And the place of the ruling, and the means of reversing the apparent meaning of the text is ijtihad , and it is required to deviate from the apparent to be probable for the meaning intended to be spent on it.
