تداعيات جائحة كورونا على الصفقات العمومية

الملخص
تعد الصفقات العمومية أفضل الأنظمة لتجسيد المشاريع العمومية في مختلف القطاعات وتضمن أحسن استغلال لأموال الدولة، لذلك نظمها المشرع الجزائري بآليات خاصة وصارمة عند إبرامها حماية للمال العام وللمتعامل المتعاقد على حد سواء، إلا أن ظهور جائحة كورونا فرض قواعده على جميع دول العالم وفي كل المجالات، بما في ذلك الالتزامات التعاقدية التي تعد الصفقات العمومية أحد أهم مظاهرها. وعليه وفي إطار الوقاية من انتشار فيروس كورونا (Covid 19) ومكافحته، حدد المشرع الجزائري تدابير خاصة مكيفا بذلك إجراءات إبرام الصفقات العمومية بما يتناسب والظروف الراهنة مراعاة لمصلحة المتعامل المتعاقد والمصلحة العمومية. Public procurements are the best systems for enbodying public projects in various sectors it guarantees the best use of state funds, there fore, the Algerians legislator regulated it with special and strict mechanism when concluded, to protect the public funds and the contracting client at the same time, exept the emergence of the corona pandemic it imposed its rules on all countries of the world, and in all areas, including contractual obligations which is the public deals one of the important aspects. And up on it, and in the context of preventing and controlling the spread of the corona virus, (covid 19) epedemic, the Algerian legislator has difined special measures, adapting to the procedures for concluding public deals in the line with the current circumstances taking into account the interest of the contracting client and the public interest..
