ولاية الدولة على الوقف و فوات المقصود منه

الملخص
بدأ الوقف ظاهرة تعبدية بسيطة، ثم تطور وتوسع وأصبح يغطي مختلف احتياجات المجتمع، لذا تم التفكير في إنشاء نظام لإدارته والمحافظة عليه، وكان الواقف هو من يدير وقفه بنفسه في البداية أو يعهد به إلى ناظر، ولكن ازدياد هذه الأموال، وضخامتها، وتنوعها، والمشاكل التي برزت بمرور الوقت أصبح لزاما على الدولة التدخل من أجل ضبط إدارة هذه الأموال، واحترام شروط الواقفين، وكان القضاء أول متدخل في إدارة الأوقاف من خلال الإشراف عليها في حالة عدم وجود ناظر أو نص الواقف على ذلك، إلا أن إتباع معظم الدول العربية النمط الغربي في بناء دولها جعل هذه الدول تتدخل في كل مناحي الحياة ومنها الوقف، وذلك بالتدخل في إدارته من خلال الولاية عليه وهو ما أدى إلى تفويت الغرض منه في كثير من جوانبه. Waqf began a simple phenomenon of worship, then evolved and expanded and covered the various needs of the community, so was thought to create a system to manage and maintain,The magnitude, variety, and problems that have emerged over time have become necessary for the state to intervene in order to control the management of these funds , and the judiciary was the first intervention in the management of the endowments through supervision in the absence of a supervisor or text endower, but the adoption of most Arab countries the Western style in the building of their countries to make these countries interfere in all aspects of life, including Waqf, In his administration through the mandate, which led to the missed purpose in many aspects.
