تداعيات فشل نظام التسيير الذاتي والبدائل التي تم اقراراها في مجال القطاع الفلاحي

الملخص
شكلت عمليات استرجاع العقارات أولوية قصوى بعد الاستقلال مباشرة، وهذا بما يتوافق مع مبدأ السيادة الوطنية والذي نص على حق الدولة الجزائرية في تأميم الاراضي المملوكة للأجانب، ومنذ ذلك الوقت والجزائر تبحث عن حلول سريعة للنهوض بالقطاع الفلاحي ،ابتداء بمعالجة مشكل العقار الفلاحي ،خاصة بعد الشغور المفاجئ لهذه الاراضي من طرف المعمرين من جهة، وما سببه استيلاء الفلاحين على هذه الاراضي من فوضى وتحويل الاراضي الفلاحية عن وجهتها الزراعية من جهة ثانية وعن اهداف الموضوع هو تسليط الضوء على احد اهم التجارب التي كرست في بدايتها التسيير الفردي في قطاع الفلاحة ،لنصل في الأخير الى نتيجة ان سوء التسيير وانعدام الخبرة والتمويل كلها عوامل أدت الى فشل نظام التسيير الذاتي الامر الذي دفع بالمشرع الى البحث عن بدائل وأليات قانونية كفيلة بالنهوض بالقطاع الفلاحي. - The restoration of real estate was a top priority after independence in accordance with the principle of national sovereignty, which stipulated the right of the Algerian state to nationalize foreign-owned lands. Since then, Algeria has been looking for quick solutions to improve the agricultural sector. Starting with the problem of agricultural real estate specially after their sudden vacancy from their foreign owners during colonization from one hand, and its takeover by peasants after independence and what it causes from chaos and the transformation of agricultural lands from their agricultural goals on the other hand. Regarding the objectives of the topic, it is to shed light on one of the most important experiences that were devoted in its infancy to individual management and in the agricultural sector; In the end, we come to the conclusion that poor management, lack of experience and financing are all factors that led to the failure of system self-management. This prompted the legislator to search for alternatives and legal mechanisms to promote the agricultural sector.
