قراءة في بعض حقوق المحبوسين على ضوء الإصلاحات الجديدة لقطاع العدالة

الملخص
أكدت الأبحاث العديدة والأطروحات والمؤتمرات التي اهتمت بمسألة الإصلاح والعصرنة الرّابطة القويّة بين الدّفاع عن الحقوق الأساسية وتحسين نوعية العمل القضائي الذي لا يكون إلاّ من خلال استعمال تقنيات ووسائل التكنولوجيا والمعلوماتية. ولعل ذلك من الأسباب التي دفعت المشرع الجزائري لإصدار عدة نصوص في إطار تعزيز ضمانات المحبوسين نذكر منها المرسوم التنفيذي رقم 05-430 الذي يحدد وسائل الاتصال عن بعد وكيفيات استعمالها من المحبوسين؛ والمرسوم التنفيذي رقم 05-431 الذي يحدد شروط وكيفيات منح المساعدة الاجتماعية والمالية لفائدة المحبوسين المعوزين عند الافراج عنهم؛ والقانون رقم 15-03 المتعلق بعصرنة العدالة، وكذا القانون 18-01 المعدل والمتمم للقانون 05-04 المتضمن تنظيم السجون وإعادة الادماج الاجتماعي للمحبوسين. ولدراسة هذا الموضوع ارتأينا الانطلاق من الإشكالية التالية: ما هي الحقوق التي كرستها هذه النصوص بخصوص المحبوسين؟ وسيتم بعد دراسة الإشكالية تقديم الاستنتاجات المتوصل اليها. Abstract: Numerous research papers, theses, and conferences that dealt with the issue of reform and modernization have confirmed the strong link between defending basic rights and improving the quality of judicial work, which can only be guaranteed via means of technology and information. Indeed, this might be one of the reasons that prompted the Algerian lawmaker to issue several texts that aim to strengthen and guarantee detainees rights. These include, but to name few, the Executive Decree No. 05-430 that defines the means of remote communication and its use by detainees; the Executive Decree No. 05-431 that specifies the conditions and modalities for granting social and financial assistance to detained indigent upon release; and Law No. 03-15 on the modernization of justice, As well as Law 18-01 amending and supplementing Law 04-05 that includes organizing prisons and social reintegration of detainees. To study this topic, we decided to start with this research problem: What are the rights that these texts provide for prisoners?
