Ḥisbah is an authentic regulatory institution that emerged within Islamic civilization, rooted in the principle of commanding good and forbidding evil and grounded in Sharīʿah. Muslim jurists and historians examined its concepts, foundations, functions, and conditions from legal and administrative perspectives, reflecting its development across different periods. Its functions encompassed market regulation, the protection of rights, and the promotion of justice and integrity in transactions, extending beyond economic regulation to moral and professional oversight. This study examines the authenticity of Ḥisbah through jurisprudential and historical sources, particularly chronicles and treatises on al-Aḥkām al-Sulṭāniyyah, alongside selected modern Arab scholarship. It adopts a critical comparative approach to Orientalist interpretations that attribute Ḥisbah to regulatory systems in ancient Greek, Roman, and Byzantine civilizations, as well as to modern Arab perspectives influenced by such claims, without sufficiently considering its distinct Islamic legal, religious, and cultural foundations.
