Résumé

يُعْنَى هذا البحثُ بالتَّعريفِ بأحدِ أعلامِ المدرسةِ المالكيّة، وهو العلّامة البدر القرافيّ (ت: 1008هـ)، مُسلِّطًا الضَّوءَ على مخطوطِهِ المعنيِّ ببيانِ حُكْمِ الخِضابِ بالسَّوادِ وغيره. وتتوزَّعُ مَحاورُ الدِّراسةِ على التَّعريفِ باسمِ المخطوطِ، وتوثيقِ نِسبتِهِ إلى مؤلِّفِهِ، وبيانِ سببِ تصنيفِهِ ومحتواهُ، فضلًا عن استقراءِ منهجِ المصنِّفِ ومصادِرِهِ، والوصفِ الفنّيِّ للنُّسخةِ المخطوطة. ويقعُ موضوعُ الرِّسالة ضِمنَ مَسائلِ الفقهِ المقارن، حيثُ سَلَكَ فيه مؤلِّفُها المنهجَ المعهودَ لدى الفقهاءِ في نقل الخلاف، وعرضِ الأدلّة، ومناقشتها. This study introduces one of the distinguished scholars of the Mālikī school, al-ʿAllāmah al-Badr al-Qarāfī (d. 1008 AH), shedding light on his manuscript devoted to explaining the legal ruling on dyeing the hair with black and other colors. The study tackles several main themes: identifying the title of the manuscript, verifying its attribution to its author, explaining the reasons for its composition and its contents, examining the author's methodology and sources, and providing a codicological description of the manuscript copy. The manuscript falls within the field of comparative Islamic jurisprudence (fiqh muqāran), in which its author follows the established juristic method of presenting scholarly disagreements, citing the relevant evidence, and critically discussing it.
