Abstract: This article examines the legal protection afforded to female civil servants during maternity leave by ensuring the safeguarding of their social rights while simultaneously preserving the requirements of the proper functioning of public services. Particular attention is given to the legislative developments introduced into the Algerian legal system following the enactment of Law No. 25-08 amending and supplementing Law No. 83-11 on Social Insurance. The study highlights the various legal mechanisms established by the Algerian legislator to strengthen the rights of female employees during pregnancy, childbirth, and breastfeeding periods through the expansion of maternity-related social rights and the reinforcement of the legal guarantees granted to them. The study further seeks to assess the impact of these legislative developments on the continuity and efficiency of public service delivery, given the relatively lengthy absences resulting from maternity leave, particularly in essential sectors that require the uninterrupted and regular provision of public services. In this context, the study explores the relationship between social insurance legislation and civil service regulations by analyzing the areas of convergence and complementarity between these legal frameworks in governing the legal status of female civil servants during maternity leave. Adopting an analytical approach, the study examines the legal provisions regulating the right of female employees to maternity leave and relates them to the fundamental principles governing the operation of public services, foremost among them the principle of continuity of public service. The findings reveal that the Algerian legislator has primarily sought to enhance social protection for working mothers. Nevertheless, the effectiveness of such protection remains dependent on the ability of the legal and regulatory framework to strike an appropriate balance between guaranteeing the social rights of female employees and ensuring the uninterrupted functioning of public services. This, in turn, requires greater coordination between social and administrative legislation, as well as the development of legal and administrative mechanisms capable of addressing the consequences arising from vacancies created by the absence of female employees on maternity leave.
