أسباب تعدد الأقوال في المسألة الواحدة داخل المذهب المالكي

Résumé

يعرض هذا البحث بعض أسباب تعدد الأقوال في المسألة الواحدة داخل المذهب المالكي، ويبيّن أن هذه المسألة تمثل جانبًا من جوانب ثرائه وامتداده التاريخي والعلمي. كما أن فهم أسباب تعدد الأقوال داخل المذهب المالكي يساعد في ضبط عملية الترجيح، ويبرز أهمية مراعاة الأصول التي بُني عليها كل قول، كما يفتح آفاقًا واسعة للبحث الفقهي المقارن وتطوير الدراسات الفقهية في العصر الحاضر. This study examines some of the reasons behind the multiplicity of opinions within a single issue in the Maliki school of law, demonstrating that this phenomenon represents one of the dimensions of its richness and its historical and scholarly development. Understanding the causes of this plurality of opinions helps regulate the process of legal preference (tarjīḥ), highlights the importance of considering the foundational principles upon which each opinion is based, and opens broad horizons for comparative juristic research and the advancement of contemporary legal studies.
