ملخص: تتناول هذه الورقة البحثية دور السر المصرفي كركيزة أساسية في النظام المصرفي، وتركز على حفظ أسرار العملاء ومنع إفشاء معلوماتهم المالية، بما يعكس أهمية حماية حقوق الأفراد وتعزيز الثقة بين العملاء والمصارف والمستثمرين والمواطنين بشكل عام. وقد كرست التشريعات الوطنية، بالإضافة إلى المعايير الدولية، مبدأ السر المصرفي، موضحة نطاقه الشخصي والموضوعي والزمني والمكاني، وحددت الالتزامات القانونية للمصارف وموظفيها تجاه حماية هذه المعلومات. ويستند الأساس القانوني للالتزام بالسر المصرفي إلى مجموعة من القوانين الوطنية والدولية، التي تمنح السرية صبغة إلزامية وتفرض عقوبات على كل من يخالفها، بما في ذلك الجرائم المهنية والجزاءات القانونية المترتبة على الإفصاح غير المشروع. كما تتضمن هذه القوانين أحكامًا لتنظيم مسؤوليات المصارف في حال الإخلال بالسر، ما يجعل الالتزام بالسر المصرفي أداة فعالة لضمان الاستقرار المالي وحماية مصالح العملاء والمجتمع، ويعزز من مصداقية النظام المصرفي ككل. Abstract: This research paper examines the role of banking secrecy as a fundamental pillar of the banking system, focusing on safeguarding client confidentiality and preventing the disclosure of their financial information. It highlights the importance of protecting individual rights and enhancing trust between clients, banks, investors, and the general public. National legislation, alongside international standards, has enshrined the principle of banking secrecy, defining its personal, objective, temporal, and spatial scope, and specifying the legal obligations of banks and their employees to protect such information. The legal basis for the obligation of banking secrecy relies on a set of national and international laws that confer mandatory secrecy and impose penalties on anyone who violates it, including professional offenses and legal sanctions for unlawful disclosure. These laws also outline the responsibilities of banks in the event of a breach, making the commitment to banking secrecy an effective tool to ensure financial stability, protect the interests of clients and society, and reinforce the credibility of the banking system as a whole.
