ترتبط بداية الشخصية القانونية بواقعة قانونية تتمثل في الولادة فتقترن البداية الطبيعية بالبداية القانونية، ولا تتأثر بجنس أو بحالة عقلية أو عمرية أو اجتماعية فيكفي تعلقها بكائن إنساني، وهو ما نص المشرع عليه في المادة 25 من القانون المدني فالأصل اكتساب الإنسان لشخصية القانونية منذ لحظة الولادة غير أنه وبشرط الولادة حيا يعترف للجنين في بطن أمه بالشخصية القانونية وتعتبر ناقصة ومؤقتة، تنتهي الشخصية القانونية بموت الشخص فتتطابق نهايته الطبيعية بالموت بنهايته القانونية ، لكن قد لا يكون موت الشخص محققا يقينا لعدم وجود معطى مادي يتمثل في جثته فيعتبر ميتا حكما،في حالة الغائب والمفقود، ويسبق حكم التمويت حكم بالفقدان وإلا اعتبر حكم الموت باطلا، لتنتهي الشخصية القانونية، إلا إذا عاد الشخص الطبيعي فتعود شخصيته القانونية للتلازم المنطقي فلا يعتبر بداية شخصية جديدة.The beginning of legal personality is linked to a legal event, namely birth. Thus, the natural beginning is linked to the legal beginning, and it is not affected by gender, mental state, age, or social status. It is sufficient that it is related to a human being, as stipulated by the legislator in Article 25 of the Civil Code. The principle is that a person acquires legal personality from the moment of birth. However, on the condition of being born alive, the fetus in its mother's womb is recognized as having legal personality, which is considered incomplete and temporary. Legal personality ends with the death of the person, so his natural end in death coincides with his legal end. However, the death of the person may not be definitively established due to the absence of a physical evidence in the form of his body, so he is considered legally dead in the case of the absent and missing person. The ruling of death is preceded by a ruling of disappearance, otherwise the ruling of death is considered invalid, so the legal personality ends, unless the natural person returns, so his legal personality returns due to the logical connection, and it is not considered the beginning of a new personality.
