Résumé

Work is a fundamental human necessity for individuals to secure their daily livelihood, whether through integration into the civil service or the economic sector. However, the professional path is not free from tensions and disputes, which prompted the Algerian legislator to establish legal mechanisms aimed at protecting the weaker party in the relationship, whether a public sector employee or a worker in the economic sector. In recent years, Algeria has witnessed a qualitative transformation in the structure of labor relations, with military-affiliated institutions entering the economic sphere. This has led to new situations involving so-called "civilian economic users," necessitating a legal study to determine the nature of the employment relationship: are we dealing with civil servants or workers subject to labor law provisions? This research focuses on analyzing the legal framework governing the resolution of individual labor disputes by addressing internal dispute resolution procedures and the competent judicial authority that may be approached after the exhaustion of internal mechanisms, based on the constitutional principle of every citizen's right to litigation. The objective of this study is to shed light on these modern legal issues within labor relations for this particular category, in order to enhance legal protection and reinforce the principle of litigation for resolving individual labor disputes.
