Résumé

تهدف هذه الدراسة إلى استجلاء دور نظام "الحسبة" في المشرق الإسلامي الوسيط كآلية فعالة للرقابة الإدارية، ومعالجة إشكالية مدى قدرة المحتسب على إخضاع كبار مسؤولي الدولة وذوي النفوذ للمساءلة القانونية والشرعية. اعتمد البحث المنهج الوصفي التحليلي من خلال استنطاق مضامين كتاب (سياست نامه) للوزير السلجوقي "نظام الملك الطوسي"، بوصفه وثيقة مرجعية تعكس خبرته السياسية الطويلة. وتوصلت الدراسة إلى جملة من النتائج؛ أبرزها أن نجاعة نظام الحسبة في الفكر السياسي لنظام الملك لم تقتصر على مراقبة الأسواق والعامة، بل امتدت لتقييد نفوذ النخبة السياسية، مما كرس مبدأ المساواة أمام القانون وحقق غايات الردع والإصلاح الإداري، وهو ما ساهم بشكل مباشر في استقرار مجتمع المشرق الإسلامي. This study aims to investigate the role of the "Hisba" system in the medieval Islamic East as an effective administrative oversight mechanism, specifically addressing the Muhtasib's ability to hold high-ranking state officials and influential figures accountable. The research employs a descriptive-analytical methodology by examining the seminal work "Siyasatnama" by the Seljuk vizier Nizam al-Mulk al-Tusi, serving as a primary source of his extensive political and administrative experience. The study concludes that the efficacy of the Hisba system, within Nizam al-Mulk’s political thought, was not limited to market regulation but extended to restraining the political elite. This promoted equality before the law and achieved the objectives of deterrence and administrative reform, ultimately contributing to the stability of Islamic Eastern society.
