الفحص الطبي قبل الزواج في التشريع الجزائري

Résumé

يُعتبر الفحص الطبي من الأحكام المستحدثة من خلال المادة 07 مكرر من قانون الأسرة الجزائري، والمرسوم التنفيذي رقم 06-154 المنظّم للشهادة الطبية للمقبلين على الزواج. فقد ألزم المشرّع الجزائري المقبلين على الزواج بإجراء فحص طبي يثبت خلوّهما من أمراض خطيرة تُهدّد استقرار العلاقة الزوجية، أو أمراض معدية قد تنتقل إلى الطرف الآخر المقبل على الزواج، أو أمراض وراثية تنتقل بزواج الأقارب إلى النسل وتُهدد الفرد بصفة خاصة والمجتمع بصفة عامة. إلا أنّ هذا التشريع بحاجة إلى إثراء لسدّ النقص والفراغ القانونيين، وهو ما سنعالجه بالدراسة والتحليل لتقديم الاقتراحات المناسبة The medical examination is considered one of the newly introduced provisions under Article 07 bis of the Algerian Family Code, as well as Executive Decree No. 06-154 regulating the medical certificate required for those intending to marry. The Algerian legislator has obliged prospective spouses to undergo a medical examination proving that they are free from serious diseases that may threaten the stability of the marital relationship, contagious diseases that may be transmitted to the other spouse, or hereditary diseases that may be passed on through consanguineous marriage to offspring, thereby posing a threat to the individual in particular and to society in general. However, this legislation requires further enhancement to address the existing legal gaps and deficiencies—an issue that we will examine through analysis and discussion in order to propose suitable recommendations.
