Résumé

الملخص: يهدف هذا البحث إلى تقديم مقاربة علمية معمّقة لمشروع تأهيل الخاطبين للزواج باعتباره آلية استباقية للحد من تفكك الأسرة والارتفاع المتزايد في نسب الطلاق والخلع في الجزائر وفي العالم الإسلامي، ينطلق البحث من تحليل رباعي الأبعاد يجمع بين الأساس الفقهي والمقاصدي المستند إلى تراث الفقهاء في باب الأسرة، والإطار القانوني والتنظيمي المستند إلى قانون الأسرة الجزائري والتجارب المقارنة، والسياق السوسيولوجي للتحولات الأسرية في المجتمع الجزائري ، ثم البعد اللساني لخطاب التأهيل وبناء الوعي الأسري. ويعتمد البحث المنهج التحليلي المقارن من خلال ربط الواقع الجزائري بالتجارب الدولية الرائدة، ولا سيما التجربة الماليزية وتجارب بعض الدول العربية التي قنّنت الفحص أو التأهيل السابق على الزواج وينتهي البحث إلى اقتراح معالم نموذج وطني جزائري لبرنامج تأهيل زواجي متكامل، يراعي خصوصيات المجتمع المحلي، ويستفيد من الخبرة الفقهية والقانونية، ومن أدوات علم الاجتماع الأسري ولسانيات الخطاب في ضبط التوقعات الزوجية وتحسين نضج القرار الأسري. Abstract: Against the backdrop of rising divorce and khulʿ rates in Algeria and the wider Muslim world, this article offers a multidimensional analysis of premarital education for engaged couples as a preventive family policy tool. Drawing on Islamic jurisprudence and the objectives of Islamic law (maqāṣid al-sharīʿa) as articulated in classical fiqh, the Algerian Family Code and recent reform debates, as well as comparative regulatory experiences in Malaysia and the Gulf region, sociology of the family, and discourse analysis, it conceptualises structured premarital programmes as a contemporary form of siyāsa sharʿiyya aimed at safeguarding the family and enhancing the maturity of the marital decision. The study adopts an analytical–comparative methodology, examining the normative foundations of premarital education, its potential legal anchoring in Algerian family legislation, the sociocultural opportunities and constraints that may affect social acceptance, and the linguistic–pragmatic features of counselling and awareness-raising discourse directed at fiancés. The article argues that the effectiveness of such programmes depends not only on their legal design and institutional governance, but also on the way roles, rights, and obligations are linguistically framed, negotiated, and internalised by future spouses. It concludes by outlining the contours of a national Algerian premarital education model that combines religious, legal, psychosocial, and communicative components, and calls for longitudinal empirical research to assess its impact on marital stability and family cohesion.
