نظام الحسبة في الدولة الرستمية (160- 296هـ/ 777- 909م)

Résumé

عرفت بلاد المغرب نظام حسبة، فمن بين تلك الدول الرائدة في تطبيقه؛ الدولة الرستمية في الغرب الإسلامي، التي اعتبر فيها هذا النظام جانب مهم من جوانب الأمن فيها، حرصت فيها على تطبيقه مع الرعية من خلال تعيين من هم أهل لها. نتسائل عن بدايات هذه الوظيفة وكيفية تسييرها، ومن هم المكلفون بمهام المحتسب. في ظل عدم إهتمام المشارقة الكافي بهذا النظام في المغرب الإسلامي، تطرقنا بالدراسة لبدايات الحسبة والقائمين بها ومهامهم في الدولة الرستمية من خلال رواية ابن الصغير في أخبار أئمتها، محاولين كذلك إثراء الموضوع بما عرفته أحواز الدولة إعتمادا على مصادر الإباضية، مع تتبع السياق التاريخي لهذه المهمة بمقارنة وضعية الحسبة في الدولة بالحواضر الأخرى. لنخرج بنتيجة فاعلية وظيفة المحتسب في أسواق أحواز الدولة وشوارعها، وتشابهها مع مهام الشرطة والقضاء هناك، رغم اختلافها تسمية وتعيينا مقارنة بحواضر المغرب الأخرى والأندلس. Abstract: The Maghreb countries were known for their Hisbah system. Among the pioneering states in its implementation was the Rustumid state in the Islamic West, which considered this system an important aspect of its security. It was keen to implement it with its subjects by appointing qualified individuals. We ask about the beginnings of this function, how it was administered, and who was entrusted with the duties of the Hisbah. Given the lack of sufficient attention paid by Eastern historians to this system in the Islamic Maghreb, we examine the beginnings of Hisbah, its practitioners, and their duties in the Rustumid state, based on Ibn al-Saghir's account in "Akhbar A'immah". We also attempt to enrich the subject with what the state's surroundings knew, relying on Ibadi sources, while tracing the historical context of this function, to compare the status of the Hisbah in the country with other capitals. We conclude that the muhtasib's role is effective in the markets around the country and its streets, and that it is similar to the duties of the police and judiciary there, despite the differences in name and appointment compared to other cities in Maghreb and Andalusia.
