Résumé

الملخص لقد سعت الشريعة الإسلامية والقانون إلى حفظ حق الجنين في الحياة، فقد تم تجريم كل أشكال الاعتداء التي تطرأ على الجنين. إذ تعد جريمة الإجهاض من أبرز صور التدخلات الطبية على الجنين والتي يرتكبها الطبيب عن قصد جنائي، بهدف إنهاء حالة الحمل قبل الموعد الطبيعي للولادة وهو الأمر الذي يفرض قيام المسؤولية الجنائية في حق الطبيب نتيجة قيامه بالاعتداء على حق الجنين في الحياة. Abstract Islamic law and Sharia have sought to preserve the fetus's right to life, and all forms of assault on the fetus have been criminalized. The crime of abortion is one of the most prominent forms of medical interventions on the fetus, which the doctor commits with criminal intent, with the aim of terminating the pregnancy before the normal date of birth, which imposes criminal responsibility against the doctor as a result of his assault on the fetus's right to life.
