Résumé

ملخص: يتمثل البحث في دراسة نقدية للتحقيق الذي قام به الدكتور عبد الرحمان الشاغول لكتاب العقد المنظم للحكام فيما يجري بين أيديهم من العقود والأحكام، لأتبيّن مدى التزامه بأصول التحقيق العلمي، وقد خلصت إلى أن الدراسة التي قام بها الدكتور عبد الرحمن فقيرة جدّا من حيث التعليق على المسائل، وشرح المصطلحات العويصة، والألفاظ المبهمة، وكذلك فقيرة من حيث التراجم للأعلام، وتخريج الأحاديث النبوية، كما أتها كثيرة الأخطاء المطبعية والاختصار والسقط في النص بشكل مخل، بالإضافة إلى الإخلال بالشكل الخارجي الذي ينظم مادة الكتاب ويسهل الوصول إليها، وبالتالي لا يمكن أن يرقى العمل الذي قام به الدكتور لأن يسمى تحقيقا علميا، وإنما هو فقط نسخة تجارية للكتاب. Abstract: This research is a critical study of the investigation conducted by Dr. Abdul Rahman Al-Shaghoul into the book "Al-Aqd Al-Muntazam Lil-Hukkam fi Yajur Baydahim Min Al-Uqud Wal-Ahkam" (The Contracting Contract for Rulers in the Matters of Contracts and Rulings Presented by Them), to determine the extent of its adherence to the principles of scientific investigation. I concluded that the study conducted by Dr. Abdul Rahman is very poor in terms of commentary on the issues, explanation of difficult terminology, and ambiguous expressions. It is also poor in terms of biographies of prominent figures and the verification of prophetic hadiths. It also contains numerous typographical errors, abbreviations, and omissions in the text in a detrimental manner. In addition to disrupting the external format that organizes the book's content and facilitates accessibility, the work undertaken by the doctor cannot be called a scholarly investigation, but rather merely a commercial version of the book.
