خصوصية مسؤولية جراح التجميل

Résumé

تتناول هذه الدراسة الخصوصية التي طالت مسؤولية طبيب الجراحة التجميلية من خلال تطرقنا إلى طبيعة التزام الطبيب الجراح وذلك تحليلنا واستقراءنا لمجموعة من القرارات التي تبين لنا أن التزامه هو التزام ببذل عناية كما هو الأمر بالنسبة للطبيب العادي، ولكن الخصوصية تكمن في أن التزامه هو التزام ببذل عناية مشددة وهذا راجع لطبيعة الجراحة التجميلية والتي في غالب الأحيان يلجأ إليها الزبون من أجل تحسين خلق الله تعالى، إلى جانب هذا تقوم مسؤولية الجراح التجميلي عن قصد في حالات معينة وعن غير قصد في حالات ذكرناها تفصيلا. This study deals with the specificity that has affected the responsibility of the plastic surgeon by mentioning the nature of the surgeon's commitment through our analysis and extrapolation of a set of decisions that show us that his commitment is an obligation to take care of himself the same as the general doctor but the privacy lies in that his commitment is an obligation to take care of the most important and this is due to the nature of plastic surgery which is often resorted to by the client in order to improve the creation of God Almighty, besides this is the responsibility of the plastic surgeon for intentionally in certain cases and unintentionally in cases that we have mentioned in detail.
