الجرائم الماسة بنزاهة الإمتحانات و المسابقات في التشريع الجزائري

Résumé

إن ظاهرة تسريب مواضيع الامتحانات بمختلف مراحل التعليم و في مختلف المسابقات المهنية ، قد شهدت انتشارا واسعا في الجزائر خلال السنوات الأخيرة، زاد في تناميها استغلال التكنولوجيات الحديثة في ارتكابها ، و أصبحت تمس بمصداقية الشهادات المتحصل عليها ، و أمام عجز العقوبات الإدارية والتأديبية في مواجهة هذه الظاهرة ، تدخل المشرع الجزائري و جرم أفعال المساس بنزاهة الامتحانات و المسابقات بموجب القانون رقم 20-06 المعدل و المتمم لقانون العقوبات ، من خلال استحداث فصل تاسع تحت عنوان المساس بنزاهة الامتحانات و المسابقات في المواد من 253 مكرر 6 إلى 253 مكرر 12 ، فجرم النشر و التسريب و الحلول محل المترشح في الامتحانات و المسابقات بوصف الجنحة و بوصف الجناية في حالة ما أدت أفعال النشر و التسريب و الحلول محل المترشح إلى الإلغاء الكلي أو الجزئي للإمتحان أو المسابقة و جعل نطاق الجريمة ينحصر في الامتحانات النهائية و المسابقات المهنية و خصص لها عقوبات أصلية و تكميلية . The phenomen of leaking exam topics in various stages of education and in various professional competitions has witnessed a wide spread in Algeria in recent years. Its growth has been increased by the use of modern technologies in committing it, and it has come to affect the credibility of the certificates obtained, and in the face of the inability of administrative and disciplinary sanctions in the face of this. The phenomenon, the intervention of the Algerian legislator and the criminalization of acts of prejudice to the integrity of examinations and competitions according to Law No. 20-06 amending and supplementing the Penal Code, through the creation of Chapter Nine under the title of prejudice to the integrity of examinations and competitions in Articles 253 bis 6 to 253 bis 12, and it is the offense of publishing Leaking and taking the place of a candidate in exams and competitions as a misdemeanor and cheating leading to total or partial cancellation of the exam or competition as a felony, and limiting the scope of the crime to final exams and professional competitions, and allocating original and supplementary penalties
