Résumé

تعدّ ظاهرة اللجوء البيئي واقع حتمي تواجهه معظم دول العالم، خاصة مع التزايد المستمر والمتواتر للكوارث الطبيعية الناتجة عن تغير المناخ وما له من أثار سلبية على حياة الأفراد في مختلف أرجاء العالم ، إلا أنّ المجتمع الدولي يتراخى دائما الاعتراف بمركز قانوني يوفر حماية للاجئين البيئيين، فلا نجد في مختلف التشريعات و المواثيق الدولية نص صريح يقر بذلك، هذا ما يدفعنا من خلال ورقتنا البحثية ضمن أشغال هذا الملتقى الدولي القيم البحث في الأسباب و العوائق التي تحول دون ذلك. Abstract: The phenomenon of environmental asylum is an inevitable reality that most countries of the world face, especially with the continuous and frequent increase in natural disasters resulting from climate change and its negative effects on the lives of individuals in various parts of the world. However, the international community is always reluctant to recognize a legal status that provides protection for environmental refugees. We find in various international legislations and conventions an explicit text that acknowledges this. This is what motivates us through our research paper within the work of this valuable international forum to investigate the causes and obstacles that prevent this.
