اللاجئ البيئي بين إشكالية تحديد وضعه القانوني وقصور الحماية القانونية الدولية

ملخص: تسبب التدهور والتهديد المتزايد للبيئة في ظهور أشكال جديدة من اللجوء، يسمى باللجوء البيئي، الذي أصبح واقعا تواجهه معظم دول العالم، خاصة مع التزايد المستمر والمتواتر للكوارث الطبيعية الناتجة عن تغير المناخ وتداعياته السلبية على حياة الأفراد في مناطق متعددة حسب ما تورده التقارير الدولية بهذا الشأن، إلا أن المجتمع الدولي يؤخر دائما الاعتراف بمركز قانوني يوفر الحماية للاجئين البيئيين، ويهدف البحث إلى معرفة الأسباب والعوائق التي تحول دون ذلك، مع إمكانية التأسيس للحق في اللجوء البيئي في ظل أحكام القانون الدولي. وقد خلص البحث إلى ضرورة وضع صك دولي للتصدي لهذا التحدي الناشئ يتضمن المبادئ والقواعد والآليات التي تضمن الحماية الشاملة لهم. Abstract: The deterioration and increasing threat to the environment has caused the emergence of new forms of asylum, called environmental asylum, which has become a reality faced by most countries in the world, especially with the continuous and frequent increase in natural disasters resulting from climate change and its negative repercussions on the lives of individuals in various regions, according to international reports in this regard. However, the international community always delays recognition of a legal status that provides protection for environmental refugees, and the research aims to find out the reasons and obstacles that prevent this, with the possibility of establishing the right to environmental asylum under the provisions of international law. The research concluded that it is necessary to develop an international instrument to address this emerging challenge that includes principles, rules and mechanisms that guarantee comprehensive protection for them.
