ملخص: لا شك أن قطاع السي احة يعد من أهم العوامل التي ترقى بالاقتصاد الوطني إلى أعلى المراتب، والجزائر من الدول التي تتميز بتنوع المناطق والمواقع السياحية، الأمر الذي يمكِّن من استغلال هذه الأخيرة بما يتناسب وخصوصيتها لتحقيق هدف المرجو منها، وأهم المقومات التي تقوم عليها السياحة ما يسمى بالعقار السياحي، أي الفضاء الذي يحمل السياحة على اختلاف أنواعها، واعتباراً لهذه الأهمية، يتطلب الأمر تنظيم قانوني يشمل ما تعلق بالعقار السياحي من أحكام وموضوعات، لاسيما أصناف ملكيته، وطرق استغلاله القانوني، وحمايته من شتى أنواع الاعتداء، خاصة وأن هذا الأخير يتخذ عدة صور، الأمر الذي يستلزم الإحاطة بجميعها، واحصائها ومن ثم تقرير العقوبات المترتبة عنها، وحماية العقار السياحي من الاعتداء الذي يشكل مساساً به، ويؤدي إلى إضعاف وظيفته، تهدف بشكل أكيد إلى ترقيته. Abstract: There is no doubt that the tourism sector is one of the most important factors that raise the national economy to the highest levels, and Algeria is one of the countries that is characterized by the diversity of regions and tourist sites, which enables the exploitation of the latter in proportion to its specificity to achieve the desired goal, and the most important elements on which tourism is based is the so-called tourist property, That is, the space that carries tourism of all kinds, and given this importance, the matter requires legal regulation that includes provisions and topics related to tourist real estate, especially its types of ownership, methods of legal exploitation, and protection from various types of abuse, especially since the latter takes several forms, which It requires taking note of all of them, counting them, and then determining the penalties resulting from them, and protecting the tourist property from aggression that constitutes a violation of it and leads to the weakening of its function. It definitely aims to promote it.
