إدماج قرارات مجلس الأمن تنفيذا لقواعد القانون الدولي الإنساني في الأنظمة القانونية الداخلية

لم تعد آليات تنفيذ قواعد القانون الدولي الإنساني وفقا لاتفاقيات جنيف وبروتوكوليها الإضافيين فعالة في مجابهة وتيرة تعقد النزعات المسلحة الحديثة، ليتصاعد بذلك دور مجلس الأمن في هذا الإطار استنادا إلى سلطاته وفقا لميثاق الأمم المتحدة حفاظا على السلم والأمن الدوليين. يحتاج التطبيق الفعلي لقرارات مجلس الأمن، تنفيذا لقواعد القانون الدولي الإنساني، ضرورة إدماجها في الأنظمة القانونية الداخلية، لتتمكن بذلك من مخاطبة الأشخاص الطبيعية والمعنوية على حد سواء، وتلزم مختلف مؤسسات الدولة بتنفيذها، فبالرغم من أن قرارات مجلس الأمن تخلق التزاما دوليا إلا أن أسلوب تنفيذها داخل كل دولة يتحدد وفقا للنظام السائد فيها. هذا وتزداد أهمية إدراج قرارات مجلس الأمن في الأنظمة القانونية الوطنية مع تطور العلاقات الدولية وتصاعد مكانة الفرد في إطار القانون الدولي، إن من حيث مخاطبته بقواعد هذا القانون ودخوله في محور اهتمامات الأمم المتحدة، أو من خلال دخوله في معاملات تجارية مع الدول، لذلك يجب أن تكون بدورها مخاطبة بقرارات مجلس الأمن، والتي يتم استقبالها في الأنظمة القانونية الوطنية وإدماجها فيها وفقا لإجراءات مسطرة في قوانينها، أو تطبيقها بشكل تلقائي مباشر بعد استقبالها. The mechanisms for the implementation the rules of the international humanitarian law, according to Geneva conventions and their additional protocols are no longer affective in confronting the complexity pace of the modern armed conflits , so in this regard , and based to its authority; the role of the security council will increase according to the United Nation Charter to maintain the international peace and security. The actual implementation of the security council resolutions , in line with the rules of the international humanitarian law ; need to be incorporated with the domestic legal systems, to enable addressing both natural and legal persons, and obligate the various state institutions to execute it , and although the security council resolutions create an international commitment; the implementation method withing each state, is defined according to its prevailing regime , so the importance of the inclusion of the security council resolutions in the domestic legal systems , is becoming increasingly important, by the development of the international relations, and increasing the position of the individual under the international law ; either by addressing him through the rules of this law , and becomes a focus of the United Nation attentions , or engaging in business transactions with the other states . However , it should be addressed using the security council resolutions received and incorporated in the domestic legal systems , according to the procedures listed in their laws , or applicate it automatically and immediately after its receipt.
