ملخص: موضوع حماية المدنيين من اهتمامات المجتمع الدولي منذ نهاية الحرب العالمية الثانية إلى يومنا هذا، نظرا لتزايد عدد ضحايا النزاعات المسلحة الدولية وغير دولية، وفي ظل التغيرات التي نراها في الساحة الدولية اليوم التي أفرزت عدة جبهات تتقاتل سواء على المستوى الداخلي أو الدولي، حيث تطرقنا إلى المحاولات التي قام بها الباحثين والمشرعين الدوليين لتحديد مفهوم المدنيين وتمييزهم عن العسكريين، كما قمنا بدراسة مدى فعالية الوسائل والآليات التي أقرها المجتمع الدولي لضمان حماية المدنيين من ويلات النزاعات المسلحة، هذا كله بغرض البحث عن النقائص التي شابت القواعد المقررة لحماية المدنيين، وبهدف إعطاء إضافة للتخفيف معاناة الإنسانية من هم النزاعات، ومحاولة إيجاد آلية تقنية للحد من انتهاكات القانون الدولي الإنساني من طرف بعض الجهات خاصة ما نعيشه اليوم من تعدي علني على أحكامه، والضحية الأولى نتيجة ذلك هم المدنيين. Abstract: The issue of protecting civilians from the concerns of the international community from the end of World War II to the present day, due to the increasing number of victims of international and non-international armed conflicts, and in light of the changes we see in the international arena today that have produced several fronts fighting both locally and internationally, where we touched upon Attempts by international researchers and legislators to define the concept of civilians and distinguish them from the military, and we have studied the effectiveness of the means and mechanisms approved by the international community to ensure the protection of civilians from the scourge of armed conflict, all with a view to searching for the shortcomings of a young man The rules established to protect civilians, and in order to give in addition to alleviate the humanitarian suffering of their conflicts and try to find a technical mechanism to curb violations of humanitarian law, international by some private actors what we live today from the encroachment of public on its provisions, the first victim as a result of that they are civilians.
