أثر المبادئ الدستورية الثابتة على ديمومة الدساتير الجزائرية

الملخص
تتشكل الثوابت الدستورية من مجموعة القيم والمبادئ التي ترسخت في المجتمع والمصنفة على أنها من دعائمه ومن مقومات قيامه، هذا ما أكدته الدساتير الجزائرية عبر تاريخها حيث أعطت لهذه الثوابـت نوعــا من القدوسيــة كما أنهــا تسمــو علــى غيرهـا من المبادئ، ومن أمثلتها نظام الدولة (جمهوري)، دين الدولة هو الإسلام ولغتها الرسمية هي العربية. تجدر الإشارة إلى أن الثوابت الدستورية هي المعيار الفاصل الذي يحدد ما إذا كان الدستور معدلا أم ملغيا، ففي حالة المساس بها نكون بصدد إلغاء فعلي للدستور، أما إذا اقتصر الأمر على التعديل أو الإضافة دون المساس بالمكانة السامية لهذه المبادئ في هذه الحالة لا يخرج عن نطاق التعديل الدستوري.ولهذا فقد عرفت الجزائر فعليا إلغاءا لبعض دساتيرها إلا أن الأمر لم يكن في يوم بالشكل الصريح أو المباشر بل كان دائما ضمنيا بين الأسطر ومثالها دستور 1976 الذي ألغي فيما بعد بصدور دستور 1989، يضاف على ذلك بأن المنظومة الدستورية الجزائرية عرفت تعديلات دستورية متعاقبة ارتبطت ارتباطا وثيقا بالأزمات السياسية والدستورية التي عاشتها خلال السنوات الماضية Formed the constitutional parameters of a set of values and principles that has taken root in society and classified as one of the foundations and the elements of his, this was confirmed by the Algerian constitutions throughout its history as given to these constants kind of Holiness as it transcends the other principles, and among these constants, the state system (Republican), which the state religion is Islam, and its official language is Arabic.
