الآليات القانونية لتفعيل الاقتصاد الرقمي بالجزائر

الملخص

الملــــخص: تناقش الدراسة مسألة انتهاج الجزائر منذ مطلع 2008 لإستراتيجية "الجزائر الإلكترونية" التي تسعى لبناء مجتمع معلوماتي واقتصاد رقمي لتحقيق أهداف نوعية وتشكيل إقتصاد بديل للموارد النفطية،حيث تضمت جملة من المحاور ترمي لتكوين حكومة إلكترونية،مواطن إلكتروني،شركات إلكترونية ،وبالتالي أصبح الاعتماد على الاقتصاد الرقمي ضرورة حتمية لا بد منها. كما نتطرق لمدى نجاعة وكفاية الآليات القانونية السارية المفعول لا سيما ما تعلق منها بالآليات المرتبطة بالتجارة الإلكترونية والآليات الإدارية المتمثلة في مشروع الحكومة الإلكترونية باعتبارهما أهم ركائز نجاح الإقتصاد الرقمي، في ظل سعي المشرع لإصدار قانون خاص بالتجارة الإلكترونية،الأمر الذي يستدعي تركيز البيئة التشريعية والتنظيمية اللاّزمة لاحتوائه. Abstract : This study discuss the issue of the adoption of algeria; since the beginning of 2009, to the "Electronic Algeria " strategywhich seeks to incorporate an information society and a digital economy in order to realize specific qualitative objectivesto form an alternative economy for oil resources. This study included also a number of key axes aimed at forming an electronic government, an electronic citizen, and electronic companies. Therefore, relying on the digital economy is aninevitable necessity. Through this study we try tohighlight the effectiveness and adequacy of existing legal mechanisms, in particular those associated with mechanisms related to electronic trade and also the administrative mechanisms represented mainly in the electronic government project in Algeria, considered as the most important pillars of the digital economy success, in light of the adoption of the Algerian legislator in the footsteps of the trend not to develop a law on electronic trade, which requires the creation of the legislative and regulatory environment necessary to contain it.
