The Political Rights Of Public Servant In Algerian Legislation

Abstract
تهدف هذه الدراسة إلى بيان أن الموظف العام شانه شان أي مواطن عادي له الحق في ممارسة الحقوق السياسة التي كفلتها الدساتير والقوانين الجزائرية ،كحق الترشح والإنتخاب والتعبير عن الأراء السياسية. لكن بصفته موظف عام ينتمي إلى الدولة ويمثلها في الوقت نفسه، فرض عليه المشرع بعض القيود الخاصة التي ينبغي عليه مراعاتها والالتزام بها عند ممارسة حقوقه السياسية ،إضافة إلى القيود العامة التي يخضع لها جميع مواطني الدولة لتحقيق استمرارية المرفق العام،وعدم المساس بوظيفته . The aim of this study is to show that public servant, like any ordinary citizen, has the right to exercise the political rights guaranteed by the Algerian constitutions and laws such as the right to stand for election and to express political opinions. However, as a public functionary who belongs to and represents the State at the same time, the legislator imposed on him some special restrictions which he must observe and abide by in the exercise of his political rights, in addition to the general restrictions to which all citizens of the State are subject to in order to ensure the continuity of the public service and not to prejudice its function.
