International Environmental Responsibility Under International Humanitarian Law: The Palestinian Case Study

Authors : Abu Nimer Suleiman .

Abstract

Abstract: This study examines international environmental responsibility in armed conflicts, focusing on the adequacy of international legal mechanisms for addressing environmental harm caused by military operations, with Palestine serving as a case study. It argues that international environmental responsibility is primarily based on the theory of risk, where liability may arise without proving fault, provided that attribution and environmental damage are established. The study finds that international humanitarian law, particularly the Hague Law, Geneva Law, and Additional Protocol I, provides a legal foundation for environmental protection during armed conflicts and supports the accountability of parties responsible for widespread environmental damage. It further concludes that Israeli practices in the occupied Palestinian territories, especially in Gaza, demonstrate the existence of the elements of international environmental responsibility due to the scale and severity of environmental harm. However, the study highlights the limited effectiveness of international accountability mechanisms, whether political or judicial, because of institutional constraints such as the veto power and the weak binding force of certain international decisions. It therefore emphasizes the need to strengthen international legal frameworks to ensure more effective environmental protection and accountability during armed conflicts.
