This study examines the principle of proportionality as a fundamental normative criterion regulating the relationship between State authority to restrict freedoms and individual rights. It analyses the principle's theoretical structure and its three elements — adequacy, necessity, and balancing — tracing its development across three comparative models: the German Federal Constitutional Court, the European Court of Human Rights, and the French Constitutional Council and Council of State. The study evaluates its presence in Algerian jurisprudence, concluding that there exists only implicit and discontinuous reference to the principle, lacking conscious methodological application. It proposes legislative and judicial recommendations to enshrine the principle within the Algerian legal system.
