الملخص
يعتبر التراث الثقافي هو الشاهد على الحضارة الإنسانية القديمة ورابط بين الشعوب في الماضي والحاضر. ونظراً لما يتمتع به من أهمية اقتصادية وسياحية للدولة وكذا أهمية ثقافية واجتماعية، تجذب المهتمين بهذا النوع من الدراسات الاجتماعية والإنسانية، كما تعتبر الجزائر مسرحا تاريخيا له تزخر بمخزون ثقافي متنوع. تطرقنا في هذه الدراسة إلى أسس ونطاق الحماية القانونية المخصصة للتراث الثقافي في الجزائر وفقا لما جاء في نصوص القانون رقم 98/04 المتعلق بحماية التراث الثقافي، فلقد وفرت الجزائر الحماية المناسبة للتراث الثقافي حيث نجدها متنوعة بين: حماية مؤسساتية، وإدارية وجنائية، وهذا ما يفسر وضع إجراءات لتسجيل وتصنيف أي ممتلك ثقافي ما. Cultural heritage is considered the witness to ancient human civilization and a link between peoples in the past and present. Due to its economic and touristic importance to the state, as well as its cultural and social significance, it attracts those interested in this type of social and human studies. Algeria is also considered a historical stage rich in diverse cultural heritage. In this study, we addressed the foundations and scope of legal protection allocated to cultural heritage in Algeria according to the provisions of Law No. 98/04 concerning the protection of cultural heritage. Algeria has provided appropriate protection for cultural heritage, which we find to be diverse, including institutional, administrative, and criminal protection. This explains the establishment of procedures for the registration and classification of any cultural property.
