العنف ضد المرأة في القانون الجزائري.

الملخص
يشكل النزاع أحد الصورة الدائمة والمستمرة التي تتسم بها الحياة البشرية، أين ينطوي هذا النزاع على أعمال عنف واعتداء، ولعل من أبرز صور هذا العنف، أعمال التعدي والعنف الممارسة ضد المرأة الذي بات قضية معقدة تثير جدلا في الساحة الدولية، وهذا ما أدى الى البحث في هذا الموضوع من أجل محاولة للإسهام في تسليط الضوء على واقع العنف ضد المرأة في الجزائر من زاوية قانونية، والحرص على تقديم قراءة فعالة تدعم الجهود الرامية إلى حماية المرأة وتعزيز حقوقها، مع العمل على تسليط الضوء على مفهوم العنف ضد المرأة و تبيان صوره و أسبابه. أين تم الوقوف على حقيقة أن موضوع العنف ضد المرأة له أهمية بالغة كونه يعالج موضوعا حساسا يمس فئة واسعة من المجتمع ، و يساهم في نشر الوعي القانوني بحقوق المرأة وآليات حمايتها ، إضافة إلى إبراز دور القانون في تحقيق العدالة والمساواة داخل المجتمع، مبرزا دور المشرّع الجزائري الذي خطا خطوات إيجابية نحو تجريم العنف ضد المرأة وتوفير حماية قانونية لها، غير أن هذه الحماية لا تزال بحاجة إلى تعزيز على مستوى التطبيق والتفعيل، بسبب وجود فجوة بين النص القانوني والواقع العملي، نتيجة لعوامل اجتماعية وثقافية ومؤسساتية Abstract: Conflict is one of the permanent and continuous features of human life, where this conflict involves acts of violence and aggression. Perhaps the most prominent form of this violence is the acts of aggression and violence practiced against women, which has become a complex issue that raises controversy in the international arena. This has led to research on this topic in order to try to contribute to shedding light on the reality of violence against women in Algeria from a legal perspective, and to ensure the provision of an effective reading that supports efforts aimed at protecting women and promoting their rights, while working to highlight the concept of violence against women and clarifying its forms and causes. It was noted that the issue of violence against women is of great importance as it addresses a sensitive issue that affects a wide segment of society, and contributes to spreading legal awareness of women’s rights and mechanisms for their protection, in addition to highlighting the role of the law in achieving justice and equality within society, highlighting the role of the Algerian legislator who has taken positive steps towards criminalizing violence against women and providing legal protection for them. However, this protection still needs to be strengthened at the level of application and activation, due to the existence of a gap between the legal text and the practical reality, as a result of social, cultural and institutional factors.
