الملخص
الملخص: تهدف هذه الدراسة إلى التعرف على دور جودة المنظومة التشريعية في تعزيز مناخ الإستثمار في الجزائر في ظل البحث عن تحقيق التنمية المستدامة ومتطلبات الإقلاع الإقتصادي الحقيقي، حيث يعتبر مناخ الأعمال والإستثمار من أهم العوامل التي تساعد على استدامة المؤسسات، وهذا ما يستدعي ضرورة القيام بتوفير بيئة قانونية إستثمارية ملائمة تساهم في خلق المبادرة وتعزيز الثقة، وتساعد على ترقية الإستثمار سواء في مجال إلإنتاج أو الخدمات من أجل تحقيق تنمية مستدامة وشاملة، ومن ثم يتوجب وضع الإطار القانوني والتشريعي المناسب الذي يواكب التطورات الإقتصادية محليا وخارجيا، وإن الإستراتيجية التنموية التي باشرتها الجزائر كخيار عملي لتحقيق الإقلاع الإقتصادي الفعلي، والخروج من التبعية لعائدات المحروقات في ظل عدم التحكم في أسعار النفط، ولتحقيق أهداف الدراسة تم إتباع المنهج الوصفي التحليلي، وخلص البحث إلى أنه بعدما كان هناك عزوف عن الاستثمار في ظل قوانين الاستثمار السابقة، نسجل إقبال معتبر على الإستثمار في الجزائر يرجع إلى ما تضمنه قانون الإستثمار الجديد من ضمانات مشجعة على الإستثمار في الجزائر. Abstract: This study aims to identify the role of the quality of the legislative system in promoting the investment climate in Algeria in light of the pursuit of sustainable development and the requirements for genuine economic take-off. The business and investment climate is considered one of the most important factors that contribute to the sustainability of institutions. This necessitates providing a suitable legal and investment environment that contributes to creating initiative, enhancing confidence, and promoting investment in both production and services in order to achieve sustainable and comprehensive development. Therefore, it is necessary to establish an appropriate legal and legislative framework that keeps pace with economic developments locally and internationally. The development strategy that Algeria has embarked upon as a practical option to achieve genuine economic take-off and to break free from dependence on hydrocarbon revenues in light of the lack of control over oil prices. To achieve the study's objectives, the descriptive analytical method was followed. The research concluded that after there was reluctance to invest under previous investment laws, there is now a considerable interest in investing in Algeria, which is attributed to the guarantees included in the new investment law that encourage investment in Algeria.
