الملخص
الملخص: يتناول هذا المقال نظام الإدارة الجماعية لحقوق المؤلف والحقوق المجاورة من حيث إطاره القانوني، باعتباره آلية حديثة وفعالة تهدف إلى حماية هذه الحقوق في ظل التحولات العميقة التي فرضتها البيئة الرقمية المعاصرة، وما صاحبها من انتشار واسع وسريع للمصنفات الأدبية والفنية بطرق غير مشروعة. وفي مواجهة التحديات المتزايدة التي أفرزها التطور التكنولوجي، يسعى المقال إلى تحليل مدى فعالية هذا النظام في ضمان حماية الحقوق واسترجاعها، بما يحقق التوازن بين مصلحة أصحاب الحقوق ومتطلبات الوصول إلى المصنفات، ويساهم في دعم الإبداع وتعزيز التنمية الثقافية. كما يتناول المقال مفهوم الإدارة الجماعية وتطورها التاريخي، والأسباب التي أدت إلى ظهورها كاستجابة عملية لصعوبات حماية الحقوق في ظل الوسائط التقليدية، مع إبراز الدور المحوري الذي تؤديه جمعيات الإدارة الجماعية في تنظيم استغلال المصنفات، وتمكين المؤلفين وأصحاب الحقوق المجاورة من تفويض إدارة حقوقهم، وضمان تحصيل العائدات المالية المستحقة بشكل عادل وفعال في البيئة الرقمية الحديثة. Abstract: This article examines the collective management system of copyright and related rights in terms of its legal framework, as a modern and effective mechanism aimed at protecting these rights in light of the profound transformations brought about by the contemporary digital environment, which has led to the rapid and widespread unauthorized dissemination of literary and artistic works. In response to the growing challenges posed by technological development, the article analyzes the effectiveness of this system in ensuring the protection and enforcement of rights, while achieving a balance between the interests of rights holders and the requirements of access to works, thereby contributing to the promotion of creativity and cultural development. The article also addresses the concept of collective management, its historical development, and the reasons behind its emergence as a practical response to the difficulties of rights protection under traditional systems. It further highlights the pivotal role played by collective management organizations in regulating the exploitation of works, enabling authors and related rights holders to entrust the management of their rights, and ensuring the fair and efficient collection of due remuneration in the modern digital environment.
