Enforcement Of The Arbitral Award In Terms Of Place

Authors : Lahrache Douniazed .

Abstract

Abstract: This research paper highlights the importance of arbitration as an alternative means of dispute resolution outside the traditional court system, given its advantages of speed, flexibility, and confidentiality in settling disputes. The paper examines the concept of arbitration from both a linguistic and technical perspective, considering it as an agreement between parties to a legal relationship to submit their dispute to arbitrators of their own choosing for resolution. It also explains the reasons for resorting to arbitration, particularly to avoid the slowness of judicial proceedings and the complexities and appeals that may accompany them. Furthermore, the paper discusses the different types of arbitration, whether domestic or international, while emphasizing its main characteristics and procedures, such as the confidentiality of deliberations and the issuance of awards by majority vote. It also addresses the enforcement of arbitral awards and its importance in ensuring the effectiveness of the arbitration system. In this context, the study examines the legal rules governing the recognition and enforcement of arbitral awards, especially within the framework of the New York Convention of 1958. The study concludes that the success of the arbitration system depends primarily on the extent to which arbitral awards are recognized and enforced in different states.
