Arbitration is generally regarded as an alternative mechanism for the settlement of disputes that may arise between the parties to a contract, whereby such disputes are resolved outside the jurisdiction of state courts. It is resorted to by the parties on the basis of their free will, which enables them to choose the type of arbitration, the applicable procedures, and even the governing law. This contractual freedom has significantly expanded with respect to private legal persons as a result of the development of international trade. By contrast, it remains restricted for public legal entities, pursuant to explicit legal provisions and strict judicial oversight, in order to safeguard the public interest, protect public funds, and ensure the continuity of public services. This article examines the principal rules governing the recourse of public law entities to arbitration, both in general and in the specific context of public-private partnership contracts. Such contracts are characterized by their complexity and long duration. Given their connection to the design, construction, and operation of public services, recourse to arbitration as an alternative means of resolving disputes arising from the interpretation or performance of these contracts is subject to a set of legal and judicial constraints that must be complied with. These constraints are consistent with the particular nature of the functions entrusted to public law entities, namely the pursuit of the public interest and the proper functioning of public services.
