آليات تكريس الصفقات العمومية الخضراء في التشريع الجزائري.

الملخص
الملخص: إن تحقيق التوازن بين الصفقات العمومية التي تهدف إلى تلبية إحتياجات الإدارات العمومية من جهة، وتلبية متطلبات حماية البيئة من جهة أخرى يستدعي على المشرع التنصيص المباشر للاعتبارات البيئية في كل مراحل إبرام الصفقات العمومية من خلال تحديد الإجراءات التي تكرس البعد البيئي كأهم معيار في تنفيذ هذا النوع من الأعمال، بالمقابل وجوب فرض آليات حمائية تردع كل متعاقد قد يتجاوز هذه المعايير، لذا تسعى دراستنا إلى تبيان المعايير البيئية الواجب توافرها في كل مراحل إبرام الصفقات العمومية مع تحديد الآليات الإدارية والوقاية الخاصة بحماية البيئة في هذا المجال. Abstract : Achieving a balance between public contracts aimed at meeting the needs of public administrations on the one hand, and meeting the requirements of environmental protection on the other hand, requires the legislator to directly stipulate environmental considerations in all stages of concluding public contracts by defining the procedures that enshrine the environmental dimension as the most important criterion in the implementation of this type of work. In contrast, it is necessary to impose protective mechanisms that deter any contractor who may exceed these standards. Therefore, our study seeks to clarify the environmental standards that must be available in all stages of concluding public contracts, while identifying the administrative and preventive mechanisms for protecting the environment in this field.
