التحديات المنهجية والواقعية لدراسة النوازل المالية المعاصرة

الملخص

ملخص: يواجه الباحثون في مجال النوازل المالية المعاصرة جملةً من التحديات والتعقيدات التي حالت في كثير من الأحوال دون الوصول إلى اجتهادات راسخة ومنضبطة بأصول الشريعة وقواعدها. تهدف هذه الدراسة إلى الكشف عن تلك التحديات وتحليلها في ضوء المنهج الفقهي التحليلي النقدي، مع التنصيص على جملة من المقترحات والمخارج التي قد يستعان بها في دراسة النوازل المالية المعاصرة. وخلصت الدراسة إلى أن التحدي الأكبر في دراسة النوازل المالية يرجع إلى اختلال المنهج الاجتهادي من جهة التكييف الفقهي، وضعف الإحاطة بالواقع الاقتصادي من جهة أخرى. مما يدفع إلى ضرورة بناء رؤية منهجية متكاملة تقوم على مراعاة المقاصد والعلل مع الالتزام بالضوابط الشرعية، وتفعيل فقه الموازنات ف ي الاجتهاد المالي. الكلمات المفتاحية: التحديات؛ النوازل المالية؛ الاجتهاد التنزيلي. Abstract : Researchers in the field of contemporary financial issues face a host of challenges and complexities that have often hindered the development of well-established juristic interpretations grounded in the principles and rules of Shariah. This study aims to identify and analyse these challenges through an analytical and critical jurisprudential methodology, while proposing a set of recommendations and solutions that can be utilised in the study of contemporary financial issues. The study concluded that the primary challenge in examining financial issues stems from an imbalance in juristic methodology regarding legal classification (takyeef fiqhi) on one hand, and an inadequate grasp of economic realities on the other. This necessitates the development of a comprehensive methodological vision based on consideration of the higher objectives and underlying causes (maqasid and 'ilal), while adhering to Shariah principles and activating the jurisprudence of balances (fiqh al-muwazanat) in financial juristic reasoning.
