صيغ استثمار الأملاك الوقفية على ضوء قانون الأوقاف الجديد رقم 25-06

الملخص
جاء قانون الأوقاف الجزائري رقم 25-06 توجها تشريعا جديدا لاستغلال واستثمار الأملاك الوقفية، يقوم على تحقق التوازن بين الحفاظ على أصل الوقف وضمان استدامة عوائده المالية، فقد وسع المشرع من صيغ الاستثمار لتشمل عقود الايجار طويلة الأمد، وعقود المشاركة والمرابحة والمضاربة والسلم والقراض إلخ..............، إضافة إلى عقد المزارعة والمساقاة بالنسبة للأراضي الفلاحية. كما أتاح فتح المجال أمام إمكانية انجاز مشاريع تنموية وتجارية وفق ضوابط شرعية وقانونية تضمن احترام إرادة الواقف مثل عقد الصيانة والترميم والبناء والتشغيل والتحويل والبناء والاستغلال، كما استحدث صيغ جديدة لاستثمار الأملاك الوقفية مثل المساهمة في رؤوس الأموال والتأمين التكافلي الوقفي والإيداع في الحسابات الاستثمارية لدى المؤسسات المالية لم تكن منصوص عليها سابقا. ويهدف هذا التنظيم إلى تفعيل دور الموارد الوقفية في التنمية الاجتماعية والاقتصادية، غير أن نجاح هذه الآليات يبقى مرهون بحسن سير الإدارة وفعالية الرقابة وتبسيط الإجراءات الإدارية. The Algerian Waqf Law No. 25-06 introduced a new legislative approach to the exploitation and investment of Waqf properties, based on achieving a balance between preserving the Waqf asset and ensuring the sustainability of its financial returns. The legislator has expanded the forms of investment to include long-term lease contracts, partnership, profit-sharing, speculation, forward sale, and profit-sharing contracts, etc., in addition to sharecropping and irrigation contracts for agricultural lands. It also opened the door to the possibility of carrying out development and commercial projects in accordance with legitimate and legal controls that ensure respect for the will of the donor, such as maintenance, restoration, construction, operation, transfer, building and exploitation contracts. He also introduced new formulas for investing endowment properties, such as contributing to capital, endowment takaful insurance, and depositing in investment accounts with financial institutions, which were not stipulated previously. This organization aims to activate the role of endowment resources in social and economic development, but the success of these mechanisms remains dependent on the proper functioning of the administration, the effectiveness of oversight, and the simplification of administrative procedures.
