Mechanisms For Safeguarding Personal Data In The Era Of Artificial Intelligence

Abstract
The right to privacy is considered one of the most important rights recognized by the Algerian legislator in the constitutional amendment of 2016, as well as under Law No. 18-07 on the protection of natural persons. This law aims to establish a legal framework for safeguarding individuals’ private lives and preserving their reputation, honor, and dignity through the protection of their personal data. However, the situation has become more complex with the unreasonable use of artificial intelligence applications, which allows access to individuals’ personal information, especially in the absence of specific legal regulations governing violations of personal data. This represents one of the greatest concerns facing the Algerian system. يعتبر الحق في الخصوصية من أهم الحقوق التي أقرها المشرع الجزائري في التعديل الدستوري لسنة 2016، وأيضا بموجب القانون 18/07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي من أجل تأطير الحماية القانونية للحياة الخاصة للأفراد والحفاظ على سمعتهم وكرامتهم بحماية معطياتهم الشخصية، لكن مازاذ الأمر تعقيدا هو استخدام تطبيقات الذكاء الاصطناعي بشكل غير معقول وهذا ما يسمح بالدخول لبيانات الشخصية للأفراد، خاصة في ظل عدم وجود تنظيم قانوني محدد يطبق في الاعتداء على البيانات الشخصية وهذا هو أحد أكبر المخاوف التي ترهق المنظومة الجزائرية.
