أهمية الطب الشرعي ومدى أثره على قناعة القاضي الجنائي

الملخص
ملخص: تهدف هذه الدراسة إلى تبيان أهمية الطب الشرعي كأداة محورية في منظومة الإثبات الجنائي، معتمدة على المنهج الوصفي التحليلي لتوضيح المفاهيم القانونية والطبية ودورها في كشف غموض الجرائم. وتوصل البحث إلى أن التقارير الطبية الشرعية تمثل ركيزة علمية تساعد القاضي في تحديد الأركان المادية للجريمة ونسبتها لفاعلها بدقة تقلل من احتمالات الخطأ القضائي. ورغم صبغتها العلمية القطعية، خلصت النتائج إلى أن المشرع الجزائري أخضع هذه التقارير للسلطة التقديرية للقاضي وفق مبدأ الاقتناع الشخصي. الكلمات المفتاحية: الطب الشرعي، الإثبات الجنائي، القاضي الجزائي، الاقتناع الشخصي، التقرير الطبي. Abstract: This study aims to demonstrate the importance of forensic medicine as a pivotal tool in the criminal evidence system, employing a descriptive-analytical approach to clarify legal and medical concepts and their role in solving crimes. The research concludes that forensic medical reports constitute a scientific foundation that assists the judge in accurately determining the material elements of a crime and attributing it to the perpetrator, thus minimizing the potential for judicial error. Despite their definitive scientific nature, the findings reveal that the Algerian legislator has subjected these reports to the judge's discretionary power, based on the principle of personal conviction.
