الملخص

ملخص: تنظم سلطات الوالي في مجال الصحة العامة في الجزائر بموجب الدستور وقانون الصحة 18-11، وتحدث هذه السلطات أثرين رئيسيين على الحقوق والحريات العامة: أثر إيجابي يكمن في اضطلاع الوالي بدوره كضامن ومفعل للحق الدستوري في الصحة بمفهومه الواسع، والذي يشمل ضمان المحددات المعيشية كالبيئة السليمة والغذاء والسكن، وفي المقابل يظهر أثر سلبي وتقييدي لهذه السلطات في الظروف الاستثنائية، كالأوبئة، حيث يلجأ الوالي إلى سلطات الضبط الإداري لفرض قيود صارمة على حريات أساسية كالتنقل والتجارة والتجمع والعمل والتعليم، تطبيقا لنظرية الظروف الاستثنائية التي تبرر مؤقتا تغليب المصلحة العامة على الحريات الفردية، وتخضع هذه الإجراءات لرقابة القضاء الإداري (مجلس الدولة) الذي يوازن بين الضرورة الصحية وحماية الحريات، ويفرض المسؤولية على الإدارة عن الأخطاء المرفقية الناتجة عن ممارساتها، كما حصل في قضايا تسخير الأطباء أو الأضرار الطبية Abstract: The governor's powers in the field of public health in Algeria are regulated by the Constitution and Health Law 18-11. These powers have two main impacts on public rights and freedoms: A positive impact lies in the governor's role as a guarantor and activator of the constitutional right to health in its broad sense, which includes guaranteeing living necessities such as a healthy environment, food and housing. Conversely, a negative and restrictive impact of these powers appears in exceptional circumstances, such as epidemics The governor resorts to administrative control authorities to impose strict restrictions on basic freedoms such as movement, trade, assembly, work, and education, applying the theory of exceptional circumstances that temporarily justify the public interest's priority over individual freedoms. These procedures are subject to the oversight of the administrative judiciary (the Council of State), which balances health necessity with the protection of freedoms, and imposes responsibility on the administration for attachment errors resulting from its practices, as happened in cases of hiring doctors or medical damages
