النظام القانوني للمقاطعة الإدارية في الجزائر The Legal Regime Of The Administrative District In Algeria

الملخص
تعتبر المقاطعة الإدارية مرحلة انتقالية تجريبية للدائرة قبل ترقيتها إلى ولاية كاملة الصلاحيات، ويتم تسييرها من قبل وال منتدب يتمتّع بجملة من الصلاحيات، تحت سلطة الوالي، بحيث تعتبر أوسع من الصلاحيات الممنوحة للولاة المنتدبين لدى والي الجزائر العاصمة. ولأجل مساعدة الوالي المنتدب على أداء مهامه تمّ تزويد المقاطعة الإدارية بمجموعة من المصالح الإدارية والمديريات المنتدبة والمجالس واللجان الموضوعة تحت سلطته. ومع أنّ استحداث هذا الجهاز الإداري تبرز عنه العديد من الإيجابيات لاسيما من خلال تجسيد وتكريس قُرب المصالح الإدارية من السكان وتقليل العبء الملقى على عاتق الولايات الكبيرة سواء من حيث المساحة أو من حيث عدد السكان، إلا أنه في المقابل تظهر جملة من السلبيات المتمثلة في انعدام الأساس الدستوري والقانوني لهذا الجهاز، وكذا غياب معايير واضحة ودقيقة للمفاضلة بين البلديات والدوائر المرشّحة للترقية إلى مقاطعات إدارية ومنه إلى ولايات كاملة الصلاحيات مستقبلا. Abstract: The administrative district is considered an experimental transitional stage for the district before its promotion to a full-fledged Wilaya. It is administered by a delegate Wali who exercises a range of powers under the authority of the Wali. These powers are considered wider than those granted to delegated Walis attached to the Wali of Algiers. To assist the delegate Wali in performing his duties, the administrative district has been provided with a group of administrative services, delegated directorates, councils, and committees placed under his authority. While the creation of this administrative body presents several advantages, particularly in bringing administration closer to the citizen and alleviating pressure on large provinces, whether in terms of geographic area or population size, however, on the other hand, a number of drawbacks emerge, notably the lack of a constitutional and legal basis for this apparatus, as well as the absence of clear and precise criteria for differentiating between the municipalities and districts nominated for promotion to administrative districts and, subsequently, to full-fledged Wilayas in the future.
