الأبعاد الدولية لمفهوم التدخل الدولي الانساني.

الملخص
إن الفكرة الأساسية التي تتمحور حولها هذه الدراسة هي موضوع مفهوم التدخل الدولي الإنساني و أبعاده الدولية، الذي أصبح من المفاهيم التي تشغل بال الكثير من أساتذة القانون، لما أثاره من جدل بين الفقهاء حول تحديد مدلوله الواضح، و يطرح أيضا إشكالات قانونية لتداخله مع عدة مبادئ أساسية تقوم عليها العلاقات الدولية المعاصرة، و تداخله حتى مع السياسة، و بالرغم من مرور التدخل الدولي الإنساني بتطورات عديدة عبر مراحل زمنية مختلفة، و تبلور فكرته ضمن شروط معينة، و محاولات لصياغة خصائصه، إلا أنه مازال يعتبر مفهوما مبهما، و تتناول هذه الدراسة الجانب النظري للتدخل الدولي الإنساني ليس للحكم على شرعية أو عدم شرعية التدخلات الإنسانية، إنما الوصول إلى تعريف يساعدنا على فهم و تحليل أعمق لمصطلح التدخل الإنساني. The principal idea of this study is the subject of the concept of international humanitarian intervention and its international dimensions, which has become the concept that occupy the minds of many professors, that have provoked between jurists about defining clear meaning, and it also poses legal problems because it overlaps with several basic principles of international law and its overlap even with politics, the international humanitarian intervention have despite the passage with many developments trough different stages of time, and its idea crystallized within certain conditions and attempts formulate, but it is still an ambiguous concept, this study concluded the theoretical aspect of international humanitarian intervention, not to judge the legality or illegality of humanitarian interventions, but to arrive at a definition that helps us understand and analyze the term.
