Abstract: This study examines the custody system in Algerian legislation, highlighting the ongoing debate between domestic law and international obligations stemming from the ratification of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) and the Convention on the Rights of the Child. The central issue lies in how legislators and the judiciary balance the principle of equality in parental responsibilities with the criterion of "the best interests of the child" as the ultimate authority in granting or revoking custody. The research employs an analytical approach to the legal texts regulating custody in the Algerian Family Code, while also considering the rulings of the Supreme Court. The study concludes that the 2005 amendment brought about a qualitative shift by placing the father second in the order of priority, thus enshrining equality. Furthermore, the findings demonstrate that the Algerian judiciary no longer adheres to a rigid order of priority, but rather grants absolute precedence to the child's best interests in cases of dispute. The research concludes that the conditions for revoking custody, such as marriage to a foreigner or travel abroad, are subject to flexible interpretation, linking them to the extent of actual harm to the child.
