البعد الشرعي والاقتصادي للعرف في تحقيق الأمن الاجتماعي: التأثير والتحديات

الملخص
إن هذا البحث يتطرف إلى موضوع مهمة للغاية في حياة الناس ألا وهو العرف، بكونه مرتكزا للأحكام الشرعية تتبدل بتبدله وتتغير بتغيره، وللأعراف والعادات المجتمعية أثر مهم في إدراك أحكام الدين والشريعة، وفي البحث توضيح لحقيقة العرف، وبيان دوره في تحقيق الاستقرار والثقة في المعاملات وتجسيد الأمن الاجتماعي في حياة الناس. وخلص البحث إلى المعوقات التي تواجه الأعراف المفيدة في المجتمع، فهذه المعوقات تتمثل في تفرع القيم والعادات وتبدلها الحثيث، وانعكاس الأفكار التغريبية، ووسائل الاتصال والتواصل الاجتماعي، وسيطرة الأنظمة السياسية والاقتصادية الغربية، وهو ما يوجب تمكين الاحكام الشرعية من خلال النزول إلى واقع الناس والتعرف على عاداتهم وأعرافهم، وذلك من خلال ضبطها، وتصويبها، ومكافحة المنحرف منها This study addresses a topic of great importance in people’s lives, namely ʿurf (custom), as it serves as a foundation for many legal rulings that change with its change and vary with its variation. Customs and societal traditions play a significant role in understanding the rulings of religion and Sharīʿa. The research clarified the reality of ʿurf and highlighted its role in achieving stability, fostering trust in transactions, and embodying social security in people’s lives. The study concluded by identifying the main obstacles facing beneficial customs in society. These challenges lie in the fragmentation and rapid transformation of values and traditions, the influence of Westernized ideas, the impact of modern means of communication and social media, and the dominance of Western political and economic systems. This necessitates empowering Sharīʿa rulings by engaging with people’s realities and understanding their customs and traditions, through regulating them, correcting them, and countering the deviant ones.
